ENFORCEMENT AND PAYMENT OF CLAIMS IN BANKRUPTCY

Bankruptcy filings in the United States have slowly dropped over the past decade, but still hover around 1 million filings per year. The majority of those filings are individual or personal filings. That said, bankruptcy courts have seen a rise in business filings in the retail, oil and gas, and health care industries. Understanding the differences between personal and bankruptcy filings and the various chapters of the Bankruptcy Code that a debtor may file under is critical to a business creditor's enforcement and payment of its claim. Judge Gargotta will give a brief overview of the filing alternatives under the Bankruptcy Code and how claims are treated and paid. Judge Gargotta will also discuss the filing of proofs of claims and the bankruptcy statutes and rules that apply to proof of claims. Judge Gargotta will also discuss the relative costs involved when a business creditor participates in a bankruptcy case.
