While zombies in the movies often prey on unsuspecting victims, real-life zombie-debt collectors attack consumers and create financial havoc for their credit histories. Zombie debts often arise following the sale of debt. Debt buyers have created a $100 billion per year industry purchasing debts at only a small fraction of their face value and, in return, typically receive limited and sometimes inaccurate information. Many of the purchased debts are unenforceable or dead debts that have the potential of resurrecting and becoming “zombie debts.”  The debts may be unenforceable against consumers because the debts never existed, have already been paid or were discharged in bankruptcy. Additionally, zombie-debt collectors may seek to collect time-barred debt. Zombie-debt collectors can resurrect debts by obtaining judgments, making settlements or persuading consumers to acknowledge or pay a portion of the debts. Professor Neil Sobol, an expert on debt collection law, will describe the creation and proliferation of zombie debts. He will also address methods of combating these real zombies.
