Eminent domain has increasingly become a topic for discussion in the realms of politics, government, and business in Texas. The state has enjoyed unparalleled economic success over the last decade. Cities are growing larger, new Texans have arrived and more are on the way. The development of hydraulic fracturing has unlocked massive oil and gas reserves across the state. All these activities require increasing amounts of water. Every aspect of this success requires infrastructure in the forms of roads, pipelines, transmission lines, water lines and reservoirs. And infrastructure requires permanent access over and across private property. How do governmental and private corporations exercise the power of eminent domain to take private property for these projects? And what legal protections exist in favor of landowners? This presentation by Professor Jim Bradbury, an expert in Texas eminent domain law, will show how it interrelates with various aspects of economic projects across the state and will include a discussion of key topics related to eminent domain in Texas.
