Endangered species legislation were instituted at both the federal and state levels to provide protection to plants and animals that faced the possibility of extinction. Because many of those protected species are found on privately owned lands, or in public water supplies, the legislation has engendered tensions between the public’s ecological objectives and private property rights, as well as between the public ecological and freshwater priorities. Drawing on ongoing and recent disputes in Texas (s.a., dunes sagebrush lizard, lesser prairie chicken, and eleven Texas freshwater mussel species), Colette Barron Bradsby and Glenn Clingenpeel will discuss the science, laws and policies surrounding these disputes, and offer insight into how interested parties might approach resolution of these disputes.
